These terms are a legal agreement between you and Safasites Ltd, trading as eMoval ("eMoval", "we", "us", "our"). By creating a driver account or accepting jobs through the app, you confirm you have read, understood and agree to these terms. If you do not agree, please do not use the app.

1. Who we are

eMoval is a trading name of Safasites Ltd, a company registered in England and Wales. Company registration number: 17203896. Registered office: 20 Wenlock Road, London, N1 7GU. You can contact us any time at support@safasites.com.

2. Your status: self-employed and independent

You operate as a self-employed independent contractor. You are not an employee, worker or agent of eMoval, and these terms do not create an employment relationship. You decide whether, when and how to accept and carry out jobs.

You are responsible for your own income tax, National Insurance, VAT (if applicable), your own vehicle, your own insurance, and for meeting all legal and licensing requirements that apply to the work you do.

3. Eligibility and documents

To work through the app you must be at least 18, legally entitled to work in the UK, and hold a valid driving licence for the vehicle you use.

You must keep current, and upload when asked, the documents we require, which may include your driving licence, vehicle MOT, motor insurance with cover appropriate to the work (such as hire-and-reward or goods-in-transit cover where relevant), vehicle registration (V5C), a DBS check where required, and goods-in-transit insurance. It is your responsibility to make sure each document is valid and that your insurance covers the type of work you carry out.

If a required document expires or becomes invalid, your account is automatically suspended until you upload a valid replacement. You must not carry out jobs while suspended.

4. Accepting and carrying out jobs

You can send offers on jobs and choose which to accept. When a customer accepts your offer, a binding agreement is formed between you and that customer for the work described, and you agree to carry it out.

You agree to keep your estimated arrival time accurate, arrive on time, carry out the work with reasonable care and skill, and complete it safely and lawfully. The contract for the work itself is between you and the customer.

5. Payment and commission

The customer pays the full agreed job price to the platform when they book, and we hold it until the job is completed. After completion, we pay you the job price minus our commission.

Your commission rate depends on your subscription plan (paid plans pay a lower rate), and the current rate is always shown in the app before and after each job. For jobs of £50 or more, commission is a percentage of the job price; for jobs under £50 a small fixed minimum commission applies instead. (At the time of writing, the percentage rate is between 8% and 12% depending on your plan; the figures shown in the app are always the ones that apply.)

From time to time we may, at our sole discretion, give you a complimentary paid-tier plan (for example PRO or ELITE) for a limited period that we choose. A complimentary plan is a discretionary benefit, not a paid subscription: it is provided free of charge, gives you no contractual entitlement, and we may end or withdraw it at any time, including before its stated end date. It ends automatically on the end date shown in the app, and it ends immediately if you take out your own paid subscription (your own subscription then applies). While a complimentary plan is active, the commission rate for that tier applies, and the rate in force is always the one shown in the app before and after each job. When a complimentary plan ends you return to the free tier and its commission rate. No fee is charged for a complimentary plan and you owe nothing in respect of it.

Payouts are made to the Stripe Connect account you set up during onboarding. You are responsible for keeping your payout details correct. Any subscription fees for paid plans are as shown in the app.

6. Cancellations

If you cancel a job you have accepted, the customer is refunded in full automatically, and the cancellation is recorded against your account. Repeated driver cancellations may affect your standing on the platform.

If a customer cancels, you are compensated based on how far the job has progressed, and the amount is calculated and paid automatically. If they cancel within 24 hours of pickup before you have set off, you keep the reserved-slot deposit. Once you are on the way, have arrived, or pickup is close, you receive a share of the job price for your time and fuel. Once the move is underway, you receive the large majority of the job price. The exact figures follow our cancellation rules.

7. Conduct and performance

You agree to treat customers with respect and to represent the service professionally. Customers can rate and review you, and you can rate them. We monitor ratings, complaints and reliability. Repeated complaints, poor reliability, or serious misconduct may lead to suspension or removal from the platform. You can use the take-a-break feature when you are not available for work.

8. Safety and honest use

You agree to follow all road traffic, vehicle and safety laws, to carry out jobs safely, and to use the app's safety features (including SOS alerts and condition photos) honestly and only for their intended purpose. Misusing these features, or submitting false photos or information, is a serious breach of these terms.

9. Insurance, liability and indemnity

You are responsible for holding valid insurance for the work you do and for any loss, damage or injury arising from your work or your vehicle. As the provider of the service, you, not eMoval, are responsible to the customer for the work.

Because we are a platform, our liability to you in connection with a job is limited to the commission we charged on that job. Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law (including for death or personal injury caused by our negligence, or for fraud). You agree to cover us for claims, losses or costs that arise from your work, your vehicle, your breach of these terms, or your failure to hold the right insurance or documents.

10. Suspending or closing accounts

We may suspend or close your account if you break these terms, let required documents lapse, misuse the app, or for legal or safety reasons. You can close your account at any time from Settings. Closing your account does not affect jobs already completed or payouts already due to you.

11. Your data

We handle your personal information, and the verification documents you upload, as described in our Privacy Policy, which explains what we collect, why, who we share it with, how long we keep it, and your rights. Please read it alongside these terms.

12. Changes to these terms

We may update these terms from time to time. When we make a significant change we will ask you to accept the new version in the app before you continue. Continuing to use the app after a change means you accept the updated terms.

13. Governing law

These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales.
